Heard learned counsel for the applicants and the learned A.G.A. of
the State.
Mediation failed as parties were not willing for mediation. After
hearing the learned counsel for the applicants, learned counsel for
the opposite party No.2 as well as learned AGA, I find that the
record discloses commission of offence for which the applicants
have been summoned.
In such a view, prosecution of complaint case No. 185 of 2008
under Sections 147, 498A, 323, 504, 506 IPC and 3/4 D.P. Act,
cannot be quashed. This application is, therefore, dismissed.
Interim order dated 6.5.2009 as has been extended from time to
time stands vacated.
The bail prayer of the applicants in the aforesaid case is directed to
be considered on the same day by the courts below. It is also open
to the applicants to move discharge application under Section
245(2) Cr.P.C.
