Counsel for the petitioners submits that pursuant to order
dated 1-1-2009, the petitioners have joined the investigation and are
no longer required for further interrogation. He further submits that
the petitioners shall appear before the Investigating Officer as and
when called upon to do so. Counsel further submits that despite the
alleged forgery in the order, the revenue entries have remained
unchanged.
Counsel for the State does not dispute the factum of
joining of investigation by the petitioner.
Keeping in view the totality of facts and circumstances of
the case, especially the fact that both the petitioners are above 70
years of age, as mentioned in the interim order dated 1.1.2009, I am
of the view that they deserve the concession of anticipatory bail.
Consequently the present petition is allowed and the interim order
dated 1-1-2009 is hereby made absolute.
