NAWAB SINGH J.(ORAL)
By this petition under Section 482 of the Code of Criminal
Procedure, petitioners seek quashing of First Information Report (for
short ‘FIR’) No.142 dated August 16th, 2005 (Annexure P2) registered
under Section 406, 498A of the Indian Penal Code (for short `IPC’),
Police Station Garhshankar, District Hoshiarpur on the basis of
compromise entered into between the parties (Annexure P1).
Paramjit Kaur – respondent No.2/complainant has stated
at bar that she has compromised the matter with the petitioners with
the intervention of the relatives and friends. Divorce has already
been granted and all matrimonial disputes have been amicably
settled. Having regard to the fact that all matrimonial differences
have been resolved, this Court is of opinion that no useful purpose
would be served by allowing the criminal proceedings to continue
against the petitioners.
In view of the above, the petition is accepted, FIR
No.142 dated August 16th, 2005 (Annexure P2) registered under
Section 406, 498-A IPC, Police Station Garhshankar, District
Hoshiarpur and subsequent proceedings arising therefrom, are
hereby quashed.
