2. 10.08.2011 Heard learned counsel for the petitioner and learned

counsel appearing for the State.

The case has been registered for the offence under

Section 302/34 of the I.P.C. on the basis of information given by

one Jai Prakash Singh who had suspected hands of Rajesh

Kumar Singh and Sanjay Kumar Singh in alleged murder of his

brother Shiv Prakash Singh @ Appu.

It is submitted on behalf of the petitioner that the

petitioner is neither named in the F.I.R. nor the informant has

given his name in a protest petition which was filed on 13th of

July, 2011 in the Court of C.J.M., Darbhanga. He further

submits that the informant has improved his initial version as

alleged in the F.I.R. by making specific allegation of firing upon

co-accused, Sanjay Kumar Singh.

He further submits that the petitioner is in custody

since 07.06.2011 without having any cogent material against

him.

Considering the aforesaid submissions, let the

petitioner, namely, Rakesh Kumar Singh @ Tunni be released

on bail on furnishing bail bonds of Rs. 5,000/- (Five Thousand

only) with two sureties of the like amount to the satisfaction of

Chief Judicial Magistrate, Darbhanga at Laheriasarai in

connection with Laheriasarai P.S. Case No. 304/2011.
