Additional Public Prosecutor for the State assisted by learned counsel
for the informant.
Petitioners seek their bail in Ramgarh P.S. Case No. 110 of
2010 registered under section 302/34 of the Indian Penal Code.
Although petitioners are named in the First Information
Report but admittedly, the informant has not seen the actual killing of
the deceased. The order of learned Sessions Judge reveals that
witnesses came to know about the names of the petitioners from the
mouth of the informant who stated to the witnesses that while he was
going towards field he had seen the petitioners fleeing away from
there in suspicious condition. Furthermore, it appears that there was
long standing enmity between the petitioners and the informant and
allegedly, they had given threatening to commit the murder of the
informant as well as other family members. Apart from aforesaid
circumstances there is nothing against the petitioners.
Considering the aforesaid facts and circumstances as well as
submissions of the parties, petitioners above named, are directed to be
released on bail on furnishing bail bond of Rs.10,000/- (ten thousand)
each with two sureties of the like amount each to the satisfaction of

learned Chief Judicial Magistrate, Kaimur at Bhabua in Ramgarh P.S.
Case No. 110 of 2010.
