5 10.7.2008 Heard learned counsel for the appellant and learned counsel

for the State in respect of IA No.520 of 2008 through which the

appellant has renewed his prayer for bail which was earlier rejected on

29.8.2007.

It has been submitted that award of life imprisonment in a

case under section 307 IPC is excessive and the appellant has

remained in custody since 20.6.2006 i.e. for more than two years.

A counter affidavit has been filed on behalf of the informant

to urge that appellant is involved in at least two other cases as per

knowledge of the informant. Since the copy of the counter affidavit

has not been served on the other side, let the same be ignored.

Considering that the injury caused to the PW 1 is in chest

and by a firearm, the prayer of the appellant for bail is rejected for the

present. If the appeal cannot be heard within one year then the

appellant, if so advised, may renew his prayer for bail.
