2. 23.06.2011. Heard the learned counsel for the

petitioners and Mrs. Veena Rani Jaiswal,

learned A.P.P. for the State.

The petitioners are apprehending

their arrest in a case registered under

Section 366A/34 of the Indian Penal Code.

It is alleged against the

petitioners and others to have enticed away

the daughter of the informant.

The statement of the victim girl

under Section 164 Cr. P. C. has been

recorded where she claims herself to be 20

years of age. Though the learned court below

assessed her age between 15-16 years. In

164 Cr. P.C. statement the victim girl has

claimed to have married with Ranjit of her

own sweet will, since her father wanted to

marry with an old person due to step mother

in the house.

It is further submitted that no

medical examination of the victim girl was

done to assess the age of the victim and

other accused persons have been granted bail

vide Cr. Misc. Nos. 10718 of 2011 and 2705

of 2011 on 08.04.2011 and 01.03.2011.

Considering the aforesaid facts,

let the petitioners, Bijay Sahani and Rudal

Sahani, be released on bail in the event of

arrest or surrender before the learned court

below within a period of twelve weeks from

today in connection with Tariyani P.S. Case

No. 52 of 2010 on furnishing bail bond of

Rs.10,000/-(Ten Thousand) each with two

sureties of the like amount each to the

satisfaction of the learned S. D. J. M.

Shivhar at Sitamarhi, subject to the

conditions as laid down under Section 438(2)

of the Code of Criminal Procedure.
