FACTS

:

The matter is called for hearing today dated 26.3.2010. Appellant present
along with his grand son Shri Bheem. The public authority is represented by Shri
Agarwal. It is the say of Shri Bheem that the appellant (his grand father) had
applied for AAY Ration Card in 2007 but the Department had issued him BPL
Ration Card No 63300466 in the last week of February, 2010. Shri Bheen not
only castigates the unduly long time taken by the Department in the issue of
Ration Card but also questions the bonafides of the Department in the matter of
issue of BPL Card instead of AAY Card. It is his say that the appellant was the
holder of AAY Card and had applied for AAY Card and, therefore, it was wrong
on the part of the Department to have issued BPL Card.

2. On the other hand, Shri Agarwal submits that the appellant’s request for
issue of AAY Card was rejected by his predecessor Shri Soran Singh due to
which BPL Card happened to be issued to him. On a query from the
Commission, he submits that presently there is no scheme to issue Ration Card
under AAY scheme.

DECISION

3. As noted above, the appellant was the holder of AAY Card and he had
approached the Food & Supplies Department for renewal of the same. In these
circumstances, rejection of his request for renewal of AAY Card seems to be
totally arbitrary unjust and unfair. Hence, in the facts and circumstances of the
case, Shri D.K. Agarwal, FSO, Circle-63, Seemapuri, Delhi, is hereby directed to
re-visit the matter and take steps to issue AAY Ration Card to the appellant in 03
months time.

4. He is directed to send compliance report to the Commission in 04 months
time.
