The petitioner is an accused in the case registered for the offence under
sections 379 and 411 of the Indian Penal Code and section 4 of the Mines and
Minerals Development Regulation Act.
Learned counsel for the petitioner submitted that the petitioner has been
falsely implicated in the case; he is the driver of the vehicle; petitioner has no
concern with the article recovered from the vehicle; petitioner has got no
criminal antecedent; he is in custody since December,2010 without any cogent
basis.
Learned APP opposed the prayer for bail of the petitioner, but has not
disputed the contention made by the learned counsel for the petitioner.
Regard being had to the facts and circumstances of the case, the above
named petitioner is directed to be released on bail on furnishing bail bond of
Rs.10,000/-(ten thousand) with two sureties of the like amount each to the
satisfaction of learned Chief Judicial Magistrate, Bokaro in connection with
Chandankiary (Bhojudih O.P.) P.S. case no.190 of 2010, corresponding to G.R.
no.1685 of 2010.
