Heard
learned advocates appearing for the parties.

On
7.3.2006, Rule was made returnable by learned Single Judge by this
Court by passing following order:

Rule returnable on
16.3.2006. Mr. IM Pandya learned APP waives service of rule on behalf
of respondent-State. Learned Sr. Advocate Mr. PM Thakkar submits that
the learned Special Judge is likely to frame the charge in the
matter. However, the learned advocate is at liberty to move an
appropriate application before the concerned Judge stating therein
about the pendency of the present matter, which is peremptorily fixed
on 16.3.2006 for final hearing and disposal.

Learned
advocate for the petitioners submit that similarly situated accused
who have preferred Special Criminal Applications before this Court,
matters have been admitted and stay is granted and the relevant
orders are produced on record.

Considering
the facts and circumstances of the case and the decision of the Apex
Court in the case of P.D.Lakhani v. State of Punjab reported in
2008(0) GLHEL-SC 41408, status quo with regard to the trial qua
the petitioners till further order.

Office
