FACTS

:

This appellant has sought information under RTI Act by his application dated
6.3.2007 requesting information from PIO, Bank of Baroda, Nagpur against four heads.
The main query of the appellant is he would like to be provided with number of days in
which he has worked as temporary staff in Akola branch for the last five years and he
also requested for the daily wage earned by him during that period. Then he has
requested for correspondence between Nagpur branch and Akola branch and action
taken in respect of the request made by him. The PIO furnished his reply vide letter
dated 22.03.2007. Dissatisfied with the reply furnished by CPIO the appellant preferred
an appeal on 7.4.2001, which was disposed of by the AA on 4.6.2007. Again aggrieved
with the said decision, the appellant preferred this appeal before the Commission.
Comments were called for from the public authority on 4.3.2008, which was received
from DGM & AA on 12.6.2008.

DECISION:

2. This case came up for hearing on 28.7.2008, which was attended by the
appellant in person along with his relative. The public authority was attended by the
following officials:

I have gone through the RTI application and other replies received in this connection.

The PIO has provided information with reference to number of days the appellant has
worked from the year 2001 to 2006. In respect of correspondence exchanged between
Nagpur and Akola Branch it is internal matter which will not be provided by the PIO. He

has also provided information pertaining to the wage payment made to the appellant.
The AA while disposing of the appeal has indicated in his reply that he is satisfied with
the information provided by the PIO. During the hearing, the appellant has stated there
is some discrepancy regarding number of days he has worked during the year 2001 to
2006. In this connection, in case if he has got some records to show that he has worked
for more number of days he is advised to submit those records to PIO and who will
verify those records with reference to Bank records and give him suitable reply.

3. In respect, wages, though the Bank has provided information with regard to the
wage he has earned during the period there is lot of discrepancy. It is learnt during the
hearing they have shown him vouchers which includes not only wages but other
expenditure incurred by the bank on that particular day. This information will not be
helpful to the appellant. I, therefore, direct the PIO to provide the concerned records for
inspection of the appellant on a mutually convenient date and after carrying out
verification he can request for copies which is relevant to him. In that case, the PIO will
provide those copies within 15 days. In this connection, the PIO stated that providing
vouchers for five years would be a Herculean task since it consists of so many
vouchers. I, therefore, request the appellant to limit his requirement to last two years so
that it will enable the Bank to show the vouchers. During the hearing, it has been fixed
that the appellant will carry out verification at Akola branch on 20th and 21st August,
2008 in the presence of PIO of Bank of Baroda, Nagpur. It is also brought to the notice
during the hearing the appellant has been giving threatening calls to Bank staff in
respect of his RTI application, which will not be entertained. I, therefore, advise the
appellant not to resort to this method in future. As far as CPIO is concerned, he has to
maintain proper atmosphere to carry out the inspection in Akola branch. After receipt of
information if the appellant is still aggrieved he is at liberty to file his appeal before the
first AA. On the above lines, this appeal is disposed of.

Let a copy of this decision be sent to the appellant and CPIO.
