Heard
Mr.Goswamy, learned Counsel for the applicant, Mr.Thomas, learned
Counsel for Mr.Vibhuti Nanavati, learned Counsel for respondent No.3
and Ms.Koetcha, learned AGP for the respondent Authorities.
In
view of the order dated 21.7.2008 passed by this Court in Civil
Application No.11930 of 2007 in Special Civil Application No.20963
of 2006, as the facts and circumstances are similar, on the same
reasoning, the present application deserves to be allowed.
Hence,
considering the facts and circumstances of the case, the applicant
is permitted to bring on record the amendment in the main Special
Civil Application, without prejudice to the rights and contentions
of the respondents in the main Special Civil Application, so far as
the amended portion of the petition is concerned.
The
application is allowed to the aforesaid extent. The applicant may
carry out the amendment within one week from today.
The
main Special Civil Application be listed for hearing on 22.8.2008.
