ORDER
1. At
the outset, Mr.Nehal Joshi, learned Advocate appearing for the
appellant does not press present Appeal from Order. However, he has
requested that suitable direction be issued directing the learned
trial Court to expedite hearing of the suit.
2. At
this stage, Mr.Joshi, learned Advocate appearing on behalf of the
applicant has submitted that the observations made by the learned
trial Court in the impugned order may come in the way of the
petitioner appellant. Such an apprehension is not well founded. Still
it is observed that whatever observations made in the impugned order
be treated as at interlocutory stage and same can never come in the
way of the parties at the time of deciding the suit. In the facts and
circumstances of the case, learned trial Court is directed to decide
and dispose of the Suit as early as possible preferably on or before
31st March, 2010. Parties to complete the pleadings within
a period of three months from today. All the concerned are directed
to cooperate the learned trial Court in early disposal of the suit.
With these, Appeal from Order is disposed of. In view disposal of
Appeal from Order, no order in Civil Application.
