Mr.Nirav
C. Thakkar, learned advocate for the petitioner states that a Trustee
of the petitioner Trust shall give an undertaking to the respondent
University in the following terms :

The
petitioner institution shall have no objection if the University
allots students on the basis of merits from the remaining pending
list. The petitioner institution shall not admit any student who is
already admitted to M.Ed. Course in another institution.

The
teaching staff as per requirement of the prescribed norms of
NCTE/UGC shall be appointed by the institution after the selection
committee of the University approves the same.

The
institution undertakes to produce the written undertaking of the
appointed staff in terms that he/she will not leave the institution
till the completion of the academic year 2008-2009.

The
institution further undertakes to conduct necessary classes and
complete the teaching work by working even on holidays including
Sundays.

The
institution also undertakes to comply with all other conditions that
may be imposed by the University.

The
institution shall have no objection if the present arrangement is
made only for the academic term 2008-2009 and the allotment of the
students for the next year will be subject to normal procedure to be
followed by the institution.

Mr.Thakkar
states that such an undertaking will be given to the respondent
University by tomorrow morning.

Mr.S.I.Nanavati,
learned counsel appearing for the respondent University states that,
in view of the above undertaking, the Gujarat University will allot
students for admissions on the basis of merits from the pending list
of students seeking admission to M.Ed. Course. Mr.Nanavati further
makes it clear that this will not entitle any student already
admitted in another institution, to leave that institution, and to
join the petitioner institution Mr.Nanavati further states that, in
view of the above undertaking, the University agrees to hold the
interviews for selection of the staff to be appointed in the
petitioner institution on or before 25th October, 2008,
and that, the University will allot students for admission to the
M.Ed. Course in the petitioner institution on 25th
October, 2008. Mr.Nanvati further makes it clear that the allotment
of the students will be made if adequate staff is appointed.

In
view of the above statements made by the learned counsel for the
respective parties, the petition is disposed of in terms thereof.

Direct
service is permitted today.
