Heard the learned counsel for the parties.

Learned counsel for the parties agreed that the controversy raised in the
present petition is akin to the controversy, which has been decided by this
Court in Writ Petition No. 3 (MB) of 2009 and other connected matters,
decided on 5.1.2009.

We, therefore, dispose of the writ petition finally with the direction that the
benefit of the order passed in Writ Petition No. 3 (MB) of 2009, shall be made
available to the present petitioner also.

Office is directed to issue a copy of the order passed in Writ Petition No.
3(MB) of 2009 also while issuing a certified copy of this order.
