Heard learned counsel for the applicant and the learned.
It is argued by the learned counsel for the applicant that the applicant is the
old mother-in-law and it is submitted that actually the deceased poured
kerosene oil on her one year old daughter and thereafter on herself and both of
them died because the applicant ( mother-in-law) and the husband would not
have any reason for burning a little child. The police was informed by the
applicant and the inquest was even done in presence of family members of the
deceased but no objection was raised at that stage and the FIR was lodged the
next day.
Per contra, learned AGA opposed the prayer for bail and argued that only the
applicant and husband have been made accused in this case.
The case of the applicant is distinguishable from the husband Sunil Kumar.
Having considered the submissions of the parties and without expressing any
opinion on the merits of the case, let the applicant Smt. Durga Devi alias
Durgawati involved in case crime No. 940 of 2009, under Sections 498A,
304B I.P.c and 3/4 D.P. Act, P.S. Jalalpur, district Jaunpur be released on bail
on her executing a personal bond and furnishing two sureties each in the like
amount to the satisfaction of court concerned.
