ORDER

RULE.

Mr.R.D. Raval, learned advocate
waives the service of notice of rule on behalf of the respondent.

In
the facts and circumstances of the case and at the request of the
learned advocates appearing on behalf of the respective parties,
present application is taken up for final hearing today.

Present
application has been preferred by the applicant – original
petitioner to restore the main Special Civil Application
which came to be dismissed for non-prosecution.

Having
heard the learned advocates appearing on behalf of the respective
parties and as the present application is not opposed by the
learned advocate appearing on behalf of the respondent, present
application is allowed and the main petition being Special
Civil Application No. 11664 of 2002 is ordered to be
restored to file. It goes without saying that on restoration of the
main petition, the interim relief granted in the main petition
being Special Civil Application
No. 11664 of 2002 will stand revived automatically. Rule is
made absolute to the aforesaid extent. No costs.
