Mr.A.S.Kakkar, Advocate has caused appearance for the

respondent-Bank. He state that Bank is ready and willing to accept the

arrangement noticed in order dated 7.12.2009 issuing notice of motion,

subject to the condition that petitioner shall pay the interest accrued on the

outstanding amount till the entire amount is paid and he shall also bear the

incidental expenses incurred by the Bank.

Mr.Arora has readily accepted the condition stated by counsel

for the respondent-Bank.

Therefore, in view of the broad consensus arrived between
CWP No.18647 of 2009 [2]

counsel for the parties, it is ordered that petitioner shall pay Rs.50,000/- to

the respondent-Bank within seven days from today and the remaining

amount shall be paid by him within six months from today, along with

interest which shall accrue on the amount to be paid by the petitioner.

Petitioner shall also pay all incidental expenses incurred by the Bank.

Counsel for the parties are further in agreement that in case petitioner fails

to adhere to the arrangement noticed above, the Bank shall be at liberty to

proceed against the petitioner in accordance with the provisions of law.

With these observations, the present writ petition is disposed of.
