Court No. - 38 Case :- WRIT - A No. - 40914 of 2010 Petitioner :- Moharpal Sharma Respondent :- State Of U.P. And Others Petitioner Counsel :- M. P. Singh Yadav,Rajesh Kumar Verma Respondent Counsel :- C. S. C. Hon'ble Shishir Kumar,J.
Heard learned counsel for the petitioner and learned Standing
Counsel.
The petitioner is aggrieved by the order of suspension dated
25.05.2010, by which the petitioner has been suspended.
According to the petitioner, the charges levelled against the
petitioner are not such which can be lead to major punishment like
dismissal, termination or removal. As such order of suspension is
not warranted.
I have considered the submission of the petitioner and perused the
record. In my opinion as it is a case of suspension pending
enquiry, therefore, normally this Court does not interfere in the
order of suspension but in the facts and circumstances of the case
the disciplinary enquiry against the petitioner be completed within
a period of two months after affording full opportunity to the
petitioner in case the petitioner cooperates with the enquiry.
The writ petition is disposed of accordingly.
No order as to costs.
Order Date :- 22.7.2010
