Heard learned counsel for the applicant, learned AGA and
perused the record.
Learned counsel for the applicant submitted that it is a cross
case and both sides have received injuries . One person
received head injury from the side of the applicant apart from
other injuries. The proceeding of that case has been stayed in
Criminal Misc. Application No.10713/09. He further contended
that the trial of both the cases may be tried jointly by the court
below.
Issue notice to the opposite party no.2 returnable at an early
date.
List 15.2.2010 before the Appropriate Court with Criminal Misc.
Application No.10713/09.
Till the next date of listing, further proceeding of Case Crime
No.478A/2008, Case No.1110/2009 (State vs. Nidhi Raj and
others) under Sections 147, 323, 324, 504, 506 & 307 I.P.C. PS.
Noorpur, District Bijnor shall remain stayed.
