Facts
arising from the Complaint:
Mr. R H Bansal filed an RTI application dated 09/12/2010 with the PIO, O/o the
Commissioner, Municipal Corporation of Delhi asking for certain information. On not
having received any information within the mandated time the Complainant filed a
Complaint under Section 18 of the RTI Act with the Commission. On this basis, the
Commission issued a notice to the Respondent on 26/04/2011 with a direction to provide
the information to the Complainant and further sought an explanation for not furnishing
the information within the mandated time.
Subsequently, the Commission received a letter dated 24/05/2011 from the,
Deemed PIO/EE(Bldg.)/HQ wherein it has been stated that the said RTI Application was
never received in their office. Further, stating that the Commission’s notice dated
26/04/2011 along with the copy of the RTI Application has been sent to the PIO (HQ)
and PIO, MCD, Shahdara South Zone for necessary action.
Decision:
The Complaint is allowed.
In view of the aforesaid the Commission hereby directs the PIO(HQ) and PIO,
MCD, Shahadra South Zone to provide the requisite information with regard to the RTI
Application dated 09/12/2010 to the Complainant before 25/07/2011 with a copy to the
Commission.
Notice of this decision be given free of cost to the parties.
