Heard the learned counsel for the petitioner and Sri Ramendra Pratap Singh,
Advocate who is appearing for respondents nos. 2 and 3.
By consent of the learned counsel for the parties this writ petition is being
finally disposed of.
The only prayer pressed by the petitioner in the writ petition is that the
petitioner’s representation which has been submitted for permitting certain
changes in the terms and conditions of the payment mode be directed to be
decided.
The petitioner’s case in the writ petition is that he has been allotted a plot by
the order dated 20th October, 2009. He submits that the petitioner had opted
for payment of plan no.2 as per Clause VI-A of the brochure. He submits that
the petitioner has submitted the representations and applications for
permitting change of payment plans. The petitioner in this context has given
several applications, one of the reminder dated 12.07.2010 has been filed as at
page 41 of the writ petition. Learned counsel submits that under the Scheme
2009 (1) Clause 18 (i) the Chief Executive Officer has right to make such
additions and alterations as may be just and expedient. Learned counsel
submits that the petitioner intends to deposit the entire amount for which he
has made applications.
After hearing the learned counsel for the parties, we are of the view that the
petitioner’s applications being pending for consideration before the Chief
Executive Officer, the same may be decided in accordance with law.
The respondent no.3, Chief Executive Officer, Yamuna Expressway Industrial
Development Authority is directed to consider and take appropriate action on
the application dated 12.07.2010 expeditiously. The petitioner may submit the
copy of this order along with his earlier application dated 12.07.2010.
With these observations this petition is finally disposed of.
