Facts
:
1. Both the parties were heard on 18/3/2009.
2. During the hearing, the CPIO stated that a point-wise response has been
furnished on the basis of available records. The appellant, however, submitted
that the CPIO has not provided him the relevant part of the note sheet containing
the approval by the competent authority for not considering the MBA degree
awarded by IGNOU for the purpose of promotion of staff. He, therefore, pleaded
for providing the reason for not recognizing MBA degree of IGNOU as a valid
qualification for promotion.
3. In his response, the CPIO stated that as a matter of policy, the degrees
and diplomas awarded by the institutions through distance mode/correspondence
are not recognized as equivalent to the degrees awarded by conventional
universities/colleges.
Decision:
4. The CPIO has duly replied and furnished the information, except the note
sheet containing the approval by the competent authority for not considering the
degrees/diplomas acquired through the study under distance mode as equivalent
to the degrees/diplomas awarded by the conventional system.
5. As pleaded by the appellant, the CPIO is directed to provide the relevant
portion of the note sheet containing the above information within 15 working days

from the date of issue of this decision, failing which penalty proceedings u/s 20(1)
of the Act would be initiated.
6. On the basis of the information made available to the appellant, he would
be free to take up the matter at the appropriate level for redressal of his
grievances.
7. With these observations, the appeal is disposed of.
