Heard the learned counsel for the applicant and the learned AGA and perused
the record.
The learned counsel for the applicant submitted that the applicant intends to
appear before the court concerned and apply for cancellation of the warrant
issued under section 82 Cr.PC., and other proceedings.
In case the applicant appears before the court concerned and applies for
cancellation of warrant/bail within one month, from today, his prayer for bail
or cancellation of warrant, shall be considered and disposed of by the court
below in the light of the principles laid down in the case of Lal Kamlendra
Pratap Singh versus State of U.P. & others (2009) 4 SCC 437.
Till the expiry of the aforesaid period of one month or the appearance of the
applicant, whichever is earlier, no coercive process shall be issued and
executed against the applicant Pramod Singh in S.T. No. 7 of 2008 (State v
Pramod Singh) arising out of crime no. 715 of 2006 under sections 307, 504
and 506 IPC, P.S. Ayodhya, District Faizabad pending in the court of
Additional Sessions Judge/FTC-III, Faizabad.
With the aforesaid observations, the petition under section 482 CrPC is
disposed of.
