Background
1. The Applicant filed an RTI application dt.15.1.09. He requested for
information against 11 points with respect to selection of candidate under
NRHM Scheme 2007-2008 in Mansa District, Punjab. The CPIO replied on
24.2.09 stating that information sought pertains to service/appointment
matter. State Govt. is appointing authority and handles all such issues as
they are implementing authority for NRHM. Under NRHM, only funds are
released by M/o Health & Family Welfare. He advised the Applicant to seek
information from State Govt. only. Aggrieved with this reply, the Applicant
filed a complaint dt.4.3.09 before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for May 5, 2009.
3. Mr.S.D.Khaparde, D.C(ID), Ms.Kusum Bhardwaj, US(ID) and Mr.Jagdish
Gogia, SO(ID) represented the Public Authority.
4. The Applicant was represented by Dr.K.K.Jindal during the hearing.
Decision
5. The Respondent submitted that the Ministry only releases the funds and the
actual implementation of the programme is done only by the State Govts.
5. The Commission directs the CPIO MH&FW to transfer the RTI application to
the concerned CPIO in Punjab with a direction that the CPIO , Punjab provide
the information directly to the Appellant by 10 June, 2009 under intimation
to the Ministry and to the Commission.
7. The appeal is disposed off.
