02/ 28.09.2011 Heard learned Counsel for the

petitioner and learned Counsel for the State.

The petitioner seeks bail in a case

which has been registered against Sadanand

Jha under Sections 406, 409, 420 of the

Indian Penal Code.

Submission is that the petitioner

was Chairman of PACS at the relevant time and

he had no concern at all with the day-to-day

activities and considering this he has been

admitted to bail in a case of similar nature

registered under Sections 420, 467, 471 of

the Indian Penal Code and Section 4/5 of the

Prevention of Corruption Act by order dated

04.03.2011 vide Cr. Misc. No. 2152 of 2011.

In a similar case the petitioner has been

admitted to bail on 15.11.2011 vide Cr. Misc.

No. 38703 of 2011.

Considering the facts and

circumstances of the case, prayer for bail is

allowed. Let petitioner Panchanand Biswas be

enlarged on bail on furnishing bail bond of

Rs. 10,000/- (ten thousand) with two sureties

of the like amount each to the satisfaction

of the learned Chief Judicial

Magistrate/court concerned, Araria in

connection with Palasi P.S. Case No. 91 of

2009.
