O R D E R
The Commission has received a complaint dated 5.9.2011 from Shri
Shasi Parkash Pandey, Dhanbad, against nonfurnishing of information by
Public Information Officer, BCCL, Dhanbad, to his RTI request dated
2.7.2011. Copy of the complaint is annexed herewith.
2. From perusal of the papers submitted by the complainant, it is observed
that complainant’s RTI request was replied to by the CPIO, Bharat Coking
Coal Ltd, vide letter dated IV/PD/RTI/11/2319 dated 2/3.8.2011.
3. The complainant has not availed the first appellate channel u/s 19(1) of
the RTI Act. In order to avoid multiple proceedings in appeal and complaint,
the complainant is advised to file his first appeal against the decision of PIO
before the Appellate Authority, BCCL Dhanbad.
4. On receipt of first appeal from the complainant, the appellate authority
is directed to dispose it of through a speaking order within four weeks of
receipt of the first appeal.
5. If the complainant is not satisfied with the reply received from AA, he is
at liberty to file second appeal before the Commission u/s 19(3) within the
prescribed time limit.
The complaint is disposed of with above directions.
