The petitioner is an accused in the case registered for the offence under
sections 413 and 414 of the Indian Penal Code and section 25(1-b)a, 26 and 35
of the Arms Act.

Learned counsel for the petitioner submitted that the petitioner has been
falsely implicated in the case; the allegation is that huge quantity of coal was
stored, which was collected through cyclist ; there is no report of theft of coal; he
is in custody since December,2010 without any cogent basis; petitioner is a
local permanent resident; there is no chance of his absconding.

Learned APP opposed the prayer for bail of the petitioner, but has not
disputed the contention made by the learned counsel for the petitioner.

Regard being had to the facts and circumstances of the case, the above
named petitioner is directed to be released on bail on furnishing bail bond of
Rs.10,000/-(ten thousand) with two sureties of the like amount each to the
satisfaction of learned Judicial Magistrate, 1st Class, Dhanbad in connection with
Nirsha P.S. case no.212 of 2010, corresponding to G.R. Case no.3031 of 2010.
