Heard learned counsel for the parties.
In this case, the petitioner has already
deposited Rs.1,00,000/- in pursuance of the order
passed by this Court on 19.12.2007. Further, it is
stated at Bar by learned counsel for the petitioner
that petitioner is ready to pay the remaining amount
which is shown in Annexure-5 with interest.
Upon this statement, I deem it just and
proper to dispose of this writ petition with the
direction that petitioner may deposit the remaining
amount along with interest within a period of one
month from today.
Upon depositing the said amount, the

respondent – Bank shall not auction the property of
the petitioner. It is also made clear that if the
petitioner will not deposit the remaining amount
within stipulated time as aforesaid, then the
respondent Bank will be at liberty to take proper
action against the petitioner in accordance with law.
With the aforesaid observation/direction, the
writ petition is disposed of.
