Heard learned counsel for the petitioner and the
learned A.P.P. for the State.
The petitioner seeks bail in a case registered under
Sections 379/411 of the Indian Penal Code.
The petitioner was arrested in another case bearing
Goraul Police Station Case No. 286 of 2009 on account of
being in possession of stolen motor cycle, which is the
subject-matter of this case. The petitioner has been
remanded in this case on 09.12.2009 and chargesheet has
already been submitted.
Learned counsel for the petitioner submitted that
the first information report has been registered against
unknown persons and the petitioner has not been put on test
identification parade, though he is in custody since
09.12.2009. It is further submitted that in another case, i.e.
Goraul Police Station Case No. 286 of 2009 the petitioner

has been granted bail by a Bench of this Court vide order
dated 11.05.2010 passed in Cr. Misc. No. 15169 of 2010, a
certified copy of which has been produced. Let it be kept on
record.
Having regard to the facts and the circumstances of
the case, the petitioner, AJIT KUMAR @ AJEET KUMAR,
is directed to be released on bail on his furnishing bail bond
of Rs.10,000/-(Rupees Ten Thousand) with two sureties of
the like amount each to the satisfaction of the Chief Judicial
Magistrate, Vaishali at Hajipur, in connection with Lalganj
P.S. Case No. 222/09, with a further condition that one of
the bailors of the petitioner must be the close relative or his
family member, who will file affidavit before the court
below giving full genealogy showing his or her relationship
with the petitioner. Further, after his release in this case, if
the petitioner is again found to be involved in criminal case
of similar nature, the court concerned would be at liberty to
take steps for cancellation of his bail bonds.
