Allahabad High Court
Shakti Kumar Mishra vs U.P.State Bridge Corporation … on 29 July, 2010
Court No. - 22

Case :- SERVICE SINGLE No. - 5205 of 2010

Petitioner :- Shakti Kumar Mishra
Respondent :- U.P.State Bridge Corporation Limited Lucknow
Petitioner Counsel :- D.K.Tripathi
Respondent Counsel :- Shishir Jain

Hon'ble Satyendra Singh Chauhan, J.

Heard learned counsel for the petitioner and the learned counsel for the
Bridge Corporation.

The present petition has been filed claiming compassionate appointment to
the petitioner.

Submission of learned counsel for the petitioner is that father of the petitioner
expired on 13.6.2005 and after his death the petitioner being the dependent of
the father moved an application for giving compassionate appointment. The
said appointment has not been given to the petitioner up till now although the
opposite parties have changed their policy and have taken a decision to give
compassionate appointment to the dependents, which was earlier banned at
the instance of the Government. Counsel for the petitioner has placed reliance
upon the order passed in Writ Petition No.4564(SS) of 2009 and submits that
case of the petitioner may be considered keeping in view the aforesaid order
passed by this Court.

Having considered the arguments of counsel for the parties, I find that since
no decision has been taken by the opposite parties up till now in reference to
the representation made by the petitioner for giving the compassionate
appointment, it would be proper to direct the opposite parties to decide the
claim of the petitioner for compassionate appointment keeping in view the
order passed in Writ Petition No.4564 (SS) of 2009 within a period of two
months from the date a certified copy of this order is produced before the
competent authority.

With the above observation, the writ petition is disposed of finally.

Order Date :- 29.7.2010
