Cross examination of Smt. Shanti Devi and Ganga Prasad, DW-1 and DW-2
by counsel for the plaintiff as well as respondent no. 2 is over.
An objection has been raised by Sri Narendra Mohan, learned counsel for the
plaintiff that the interest of the defendant I Set and defendant II Set is
common and therefore no cross examination from the side of defendant I Set
of the witnesses of defendant I Set is permissible. He has also raised an
objection that certain questions in cross examination on behalf of defendant II
Set were beyond the pleadings contained in the written statement of
defendants. Let these objections be considered at the final hearing.
The examination in chief on the affidavit of the witnesses of the defendant II
Set, is already on record. The said witnesses may be produced for cross
examination on 26th July 2010.
