ORDER
1. Heard
learned advocate Mr. S.B. Parikh appearing on behalf of applicant and
learned advocate Mr. Vikram Thakor appearing on behalf of respondent
claimant.
2. The
present application is filed by Insurance Company with a prayer to
condone the delay of 33 days in filing First Appeal.
3. I
have considered the submissions made by both the learned advocate and
also considering the averments made in this application on oath, the
delay of 33 days in filing First Appeal is hereby condoned as
sufficient cause is shown by applicant in the interest of justice and
prayer made in Para 10(a) is granted.
4. Accordingly,
present Civil Application is disposed of.
5. Let
registry may register the First Appeal and notify the same for
admission on 1st
August 2008.
6. Registry
is directed to notify Civil Application No.8584 of 2008 along with
First Appeal on 1st August 2008.
