The order was passed on 03.09.1997 and a statement made by the counsel at
that time that the writ petition has become infructuous as such the Court was
pleased to dismiss the writ petition as infructuous. Now the application has
been filed by another counsel in 2009 for recall of the said order. The writ
petition was dismissed on the ground of statement made by the Counsel.
Therefore, another counsel by making an application cannot say or cannot
averred in affidavit that statement was incorrect or should not have been
made. The application is hereby dismissed.
