                                         ORDER

Shri R. Subbiah, the appellant has filed this appeal dated 18.2.2011 before the
Commission against the Airports Authority of India, New Delhi for not providing
information to his RTI-request dated 25.10.2010, which came up for hearing on
16.06.2011. The appellant was absent, whereas the respondents were represented by
Shri M. Natarajan, Asstt. GM, Shri D.P. Mamgai, Assistant Manager, Shri B.S. Patnaik,
Junior Executive and Shri Arun Mahadevan, Junior Executive.

2. The appellant filed RTI-request dated 25.10.2010 seeking information on nine RTI-
queries pertaining to his terminal benefits after retirement. The PIO, vide letter No. A-
60012/4/10/Disc-PIO-BS-56/10/63 dated 26.11.11 has denied information to the appellant
because as he has raised queries, which do not qualify to be ‘information’ as defined in the
RTI Act.

3. Aggrieved by reply of PIO, the appellant preferred first-appeal before FAA, on
1.1.2011. The FAA vide order No. 048/Appeal (HR)/2011 dated 2.2.2011 has upheld the
reply of PIO.

4. The appellant in his second-appeal has stated that he has sought reasons for
withholding of Gratuity after superannuation through his RTI-request, which the
respondent are bound to provide.

5. After hearing the respondent and on perusal of the relevant documents on file, the
PIO is directed to quote relevant provision of Service Rules, to the appellant within two
weeks of the receipt of this order, under which his gratuity has been withheld.

The matter is accordingly disposed of with the above direction.
