Dated this the 23rd day of May, 2009
JUDGMENT
The main dispute raised in this writ petition relates to the
permission sought by the petitioner to reside outside the barracks.
By Annexure R1(a) order dated 07-05-2009 the said request has
been granted for a period of three months with effect from 07-05-
2009. Therefore, the main grievance of the petitioner stands
redressed.
2. The petitioner, however, requests that he may be allotted a
quarter in the barracks on medical grounds. The learned standing
counsel appearing for the respondents submits that as the
petitioner is due for transfer within a month, he cannot be allotted a
quarter in Cochin.
3. In the light of the fact that the petitioner is due for transfer,
I am of the opinion that the petitioner cannot claim that he should be
allotted a quarter within the barracks in Cochin. Within the period of
three months referred to Annexure R1(a) order, the petitioner will be
transferred out of Cochin. That being the situation, the said request

cannot be entertained. The writ petition has, in my opinion, become
infructuous.
The writ petition is accordingly closed as infructuous.
