ORAL
ORDER
(Per
: HONOURABLE THE CHIEF JUSTICE MR. S.J. MUKHOPADHAYA)
The
case relates to industries situated within Sarigam Industrial Estate
at Sarigam, Valsad. The petitioners, pursuant to an order passed by
this Court on 2.7.2010 in SCA No. 7652 of 2009, were required to
deposit the requisite amount with Sardar Vallabhbhai Patel National
Institute of Technology (SVPNIT) for inspection of their unit. It
was ordered that if they do not deposit the requisite amount for
inspection of their respective industry, then the Gujarat Pollution
Control Board may close the units.
The
petitioners’ units having not deposited the requisite amount within
the time, Gujarat Pollution Control Board ordered to close their
units. In this background, the writ petitions have been preferred.
Now
it is informed that all the petitioners’ units have deposited the
requisite amount with SVPNIT, which is also confirmed by Mr. Sunil
Mehta, learned counsel appearing on behalf of the Gujarat Pollution
Control Board. In view of such development, we direct SVPNIT to
inspect the units of the petitioners and submit report before the
Gujarat Pollution Control Board, who will pass appropriate order
taking into consideration the report as may be submitted by SVPNIT.
All these writ petitions stand disposed of with the aforesaid
observations. No costs.
