Information Sought:
The Appellant through his application under the RTI Act dated 17/09/2010, sought certain information on
5 points/queries. The RTI Application was received by the PIO on 21/09/2010, as stated in his reply dated
06/10/2010. The Appellant has sought the copies of the charge sheet issued in respect of the bogus
disbursement of Farmer Loans by the then Branch Manager of the Bank branch at Talheta in the year
2004 - 2005, list of all office incumbents of the post of Deputy Chief Managers of the concerned branch,
list of field officers posted at the said branch in the period June 2004 to 2008 etc

CPIO Reply:
The CPIO through his reply dated 06/10/2010, provided information on points 2,3,4, and 5 and has
claimed exemption under Section 8 (1) (h) regarding query no. 1 as the matter is being investigated by
Government agencies and the disclosure of such information may impede the process of investigation.

Grounds for First Appeal:
The Appellant stated that he did not receive a response from the CPIO.

Order of the First Appellate Authority:
The First Appellate Authority ordered that the information sent by the CPIO was correct, except in the
case of query no. 03 and the CPIO was directed to provide information on the same within 15 working
days.

Grounds for Second Appeal:
The Appellant is not satisfied from the CPIO's Reply.

Appellant: Absent;

Respondent: Mr. J. S. Walia, PIO & Chief Manager;

The PIO had denied giving the copy of the FIR filed with the Police which the Appellant had
sought in query-1. The PIO has claimed exemption under Section 8(1)(h) but has not been able to justify
how disclosure of information would impede the process of investigation.
Decision:

The Appeal is allowed.

The PIO is directed to provide a copy of the FIR to the Appellant before
25 November 2011.

Notice of this decision be given free of cost to the parties.
Any information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.
