The petitioners are accused in the case registered for the offence under
section 435 of the Indian Penal Code and section 17 of C.L.A. Act.
Learned counsel for the petitioners submitted that the petitioners have
been falsely implicated in the case; they are not named in the F.I.R.; nothing
incriminating has been recovered from the petitioners’ possession; petitioner
no.3 said to have confessed before the police and on his confessional
statement, the names of other petitioners transpired; there is no other cogent
material against them; petitioner nos.1, 2 & 4 are in custody since
November,2010 and petitioner no.3 is in custody since July,2010.
Learned APP opposed the prayer for bail of the petitioners and submitted
that the petitioner is a resident of State of Bihar and there is likelihood of his
absconding, if he is released on bail.
Regard being had to the facts and circumstances of the case, the above
named petitioners are directed to be released on bail on furnishing bail bond of
Rs.10,000/-(ten thousand)each with two sureties of the like amount each to the
satisfaction of learned Chief Judicial Magistrate, Koderma in connection with
Satgawan P.S. case no.32 of 2010, corresponding to G.R. Case no.376 of 2010
with the condition that the bailors on behalf of the petitioners must be the local
permanent residents of the place within the territorial jurisdiction of learned court
below and that the petitioners shall physically appear on all the dates in the
case as and when their personal appearance is required in the court below.
