Heard learned counsel for the petitioner.
Learned Motor Accident Claims Tribunal has
returned the claim for filing before the Tribunal
having jurisdiction. The reasons for returning the
claim is that no documentary evidence with regard to
the residence of the petitioner in Balotara is
produced except affidavit. Admittedly, the petitioner
is bonafide resident of State of Gujarat and accident
took place in District Sanchore. Obviously, the
Tribunal can ask the claimant to file any document to
prove his place of residence. But, no documentary
evidence has been filed by the petitioner for his
residence at Balotara.
In this view of the matter, no case for
interference is made out. Hence, the writ petition is
dismissed.
