Facts
:
1. The case was heard on 10.12.2008 in absence of the appellant.
2. The CPIO stated that the information asked for has been furnished, except
the ACR’s grades. He stated that evaluation of performance of employees is a
confidential activity, disclosure of which is not in public interest. He also stated that
in the past there have been complaints against the appellant for his misbehavior with
the passengers. And, he has accordingly been provided counseling to improve his
conduct and behavior. He expressed the view that the disclosure of the information
asked for by the appellant could be mis-used against the officers, who have
contributed to the award of grades.
Decision:
3. The criteria for assessment of annual performance of employees should be
objective and transparent to allow for scrutiny of evaluation process. Without letting
the parties know about the rules of the game and the system of award of rewards or
punishments, it is not possible to ensure fair play and justice to all the players. It is

imperative therefore to reveal the system of performance appraisal as well as its
outcome to all the affected persons. The appellant has, in the instant case, right to
know the ACR grades so that he could accordingly plan to improve his scores, which
would determine the prospects for future career growth.
4. In view of the foregoing, the CPIO is directed to disclose the ACR grades of
the appellant for the period beginning from 1996 to date as asked for by him. The
remarks, if any, made by the reporting/reviewing officers should however be withheld
u/s 10(1) of the Act, as the disclosure of such details may lead to personal acrimony
and affect life and liberty of the concerned officials.
5. The desired information should thus be disclosed as per the above direction
within 15 working days from the date of issue of this decision.
6. The appeal is thus disposed of.
