2 16-09-2010 Today the matter has been listed for passing

orders on the limitation petition which has been filed to

condone the delay of 45 days in preferring this Letters

Patent Appeal.

However, learned counsel for the State of

Bihar and its officials who are appellants fairly submits

that several other Letters Patent Appeals involving the

same matter have already been dismissed by this court in

view of order dated 9-3-2010 passed in LPA no.

407/2010.

In view of aforesaid submission, there is no

necessity of issuing any notice either in the limitation

matter or in respect of the appeal. Following the orders

passed in LPA no. 407/2010 and LPA no. 682/2010

dismissed on 20-4-2010, this appeal is dismissed.
