The decision in the captioned case is reproduced below: 5. The Respondent Shri S.P.Singh submitted that complete information was provided to the   Complainant on 1.12.09.  He stated that during the hearing held on 4.1.10, ICMR was not present as   it was not directed by the Commission to appear for the hearing on that day(only NIMR was invited   for the hearing by the Commission).  However, he has been directed to appear for the hearing in the   instant case by the Commission, along with the explanation to the show cause notice issued to him   for the delay in furnishing of information. 6. The Commission after hearing the submission holds that complete information has been   provided within the stipulated time period and drops the penalty proceedings against the  PIO, ICMR. 2.
