Heard learned counsel for the petitioner and perused the record.

This petition by the tenant is directed against an order dated 18.5.2010
by which his application for issuance of Commission has been
rejected.

Having heard learned counsel for the petitioner, it is apparent that the
case is a old one and is fixed for argument and the Commission
cannot be used for collecting evidence on behalf of the parties as the
case of the parties has to be approved by themselves. The court below
has rightly rejected the application.

For the reasons above, this is not a fit case for interference under
Article 226 of the Constitution of India. Rejected.
