Background
1. The Applicant filed his RTI application dt.27.11.07 with the PIO, DRM Office, Northern
Railway, Ambala Cantt seeking information against 5 points relating to Railway Plans
No.70Misc/1946 DLI and No.M287 R1/BT11955 The PIO replied on 4.12.07 and
dissatisfied with the reply, the Applicant filed a complaint dt.18.1.08 before CIC. The then
Information Commissioner, Shri O.P.Kejriwal vide his Order dt.29.9.08 remanded the
case back to the Appellate Authority. The Appellate Authority replied on 3.11.08 informing
the Applicant that copies of plans cannot be provided as they are very old (1946) and not
in a condition to be copied . He furnished the remaining information. Not satisfied, the
Applicant then filed a complaint dt.19.11.08 before CIC stating that Respondents had not
provided the plans of the sites.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing
for April 12, 2010.
3. Shri T.R.Sharsar, PIO; Shri Sunil Verma, Ch.OS representing the Appellate Authority’;
Shri Neeraj Bhandari, Sr.DEN/II and Shri Jai Prakash, Jr. Engineer represented the
Public Authority.
4. The Applicant was not present during the hearing

5. The Respondents produced before the Commission the 3 original site plan prepared in
1946, which were indeed not in a condition to be copied. He added that the Applicant
had been requested vide letter dt.3.1.08 of the Appellate Authority to visit the office and
inspect the plans or if he wishes to have the copy of the drawing, the same may be
collected after depositing Rs.16,924/ for the 3 plans
6. The Commission after hearing the submission of the Respondent directs the Appellant to
either visit the office on a mutually convenient day to see the plans of the sites to satisfy
himself and/or deposit the amount as sought by the Respondent to reproduce the
drawings if he requires. The Respondent may on receipt of this Order send a break up
of the amount Rs.16,924/ to the Appellant
7. The appeal is accordingly disposed of.
