Facts

:­ 

1. Appellant   submitted   RTI   application   dated   4 
October   2010   before   the   CPIO,   National   Insurance 
Company   Limited,   New   Delhi   to   seek   information 
pertaining   to   car   Insurance   claims   particularly   in 
respect   of   “Total   Loss”   and   “Cash   Loss”   through   six 
points – enclosed herewith as Annexure A.

2. Vide   CPIO   order   of   2   November   2010   point   wise 
information was provided to the appellant.

3. Appellant   preferred   appeal   dated   12   November 
2010   before   the   first   appellate   authority   through 
which   he   sought   specific   and   clear   information   in 
respect of points 4 and 6 of his application.

4. Not   receiving   a   response,   appellant   preferred 
second appeal before the Commission. 

5. Matter   was   heard   today.   Both   parties   as   above 
were present in person and made submissions.

6. Having heard both parties, Commission directs as 
follows:

   Appeal : No. CIC/DS/A/2011/000550

Point   4:  respondent   is   directed   to   provide 
definition   of   Cash   Loss   and   Total   Loss   as   per 
their manual.

Point 6:  appellant has clarified at the hearing 
that   the   insured   has   died   in   the   car   accident 
and wishes to have information regarding whether 
the   insurance   company   or   the   legal   heirs   are 
obliged to sell the wreck of the car as per the 
existing   rules   of   the   company.   A   copy   of   the 
rules   as   applicable   will   be   provided   by   the 
respondent.

7. Information   as   above   to   be   provided   within   two 
weeks of receipt of order.

8. It  is also  noted  that the  CPIO  has also  signed 
on   the   order   of   the   first   appellate   authority   which 
is   contrary   to   the   provisions   of   the   RTI   Act. 
Respondent CPIO is directed to be careful in adhering 
to   the   provisions   of   the   Act   in   future   while 
disposing of RTI applications.
