The appellant had sought about certain people employed in the Health department. The
Commission had opined at its hearing on 8 October, 2008 that the delay in providing the
information was justified considering all the factors which have outlined in its earlier interim
order issued in the open chamber on 8 October, 2008.
On that day the appellant had charged that one of the points of information provided to him, –
ie. Mr. Devender Dutt was not shown as working in Kasturba Hospital,- was false.
The Commission therefore directed the Appellate Authority to investigate and report on the
matter. The First appellate authority has submitted her reply in which she has attached the
replies of the various officers who were involved in supplying the information. She finds that
Mr. Devender Dutt is working in Kasturba Hospital and that it appears to be a mistake of one
clerks at the Kasturba Hospital.
Decision:
The appeal is allowed.
The PIO will send the information to the appellant about Mr. Devender Dutt being in
employment at Kasturba Hospital and admitting the earlier mistake by 6 November, 2008..
Notice of this decision be given free of cost to the parties.
