365 days working – Judges not supermen: Jt Katju

justiceJudges are not “supermen” and they also require some rest, was how a former Supreme Court judge expressed his disapproval to Chief Justice of India R M Lodha’s suggestion of making courts function all round the year.

“The Chief Justice of India has said that Courts should remain open 365 days in a year.

  1. to a first time visito to a court the session starting at 10 am or at 11 a.m till 1 p.m and then from 2 p.m to 4 pm would at first glance wuld seem much too liberal vis a vis the 48 hr working week for others. But then they they have to study the case before hand and be absolutely attentive and focussed during hearing of the cases requires too much of an effort of cool,undisturbed, dispassionate thinking so tat no innocent gets piunished. Working for seven days a week by 52 weeks in an year would would make adjudication of cases would render judiciary a ” a production line chain job” leading to a plethoric generation od appeals/revisions/reviews/ writ petitions and the like all in all a self defeating exercise.

    Other measures to improve output needs to be revised. One Could be heavy fines on vexatiov and mischievious filing of cases particularly at the High Courts. secondly wide spread use of scienyic help in resolving cases ; for example in a paternity case of a 30 to 40 year old adult; a DNA test would resolve such a case within a week – in the present system such a case goes on for decades adding to the choking of the system . Mandatory DNA Testing should be the norm rather than the exception and the Plintiff/ Defendant should have no say in thre matter -”
    Similarly all such scientific helps should be utilised to the hilt without any compunction. Scientific tests are are 100 % objective and correct.
