Kin of road mishap victim awarded Rs 17.68 lakh

The family members of a youth, who died in an accident in 2009, have been awarded a compensation of over Rs 17 lakh by Motor Accident Claims Tribunal (MACT).

The order came on a petition filed by the family of 25-year-old Ritesh Kumar Singh, whose motorcycle was hit by a car in Gurgaon on May 23, 2009. He succumbed to his injuries in June.

MACT judge Harish Dudani directed IFFCO TOKIO General Insurance Company Ltd, with which the offending car was insured, to pay a compensation of Rs 17.68 lakh to the family.

The tribunal told that, “In view of the testimony of witnesses of petitioners and documents on record, the petitioners have succeeded in proving that the deceased (Ritesh) died due to injuries sustained in this accident caused by the offending vehicle driven by respondent number one (Nishant Beniwal).”

The petitioners said Ritesh was going to meet his friend Brijesh Prasad Singh when the accident took place. Singh was an eye-witness of the incident.

They alleged that after the accident, the driver and owner of the offending vehicle — Nishant Beniwal — fled from the spot, leaving the car behind. An FIR was lodged against him based on the statement of the victim’s friend.

Ritesh sustained multiple fractures as well as head injury and was admitted to a private hospital here, his family members said. He was then referred to AIIMS trauma centre but he died during treatment on June 6.

Beniwal did not appear before MACT during the proceedings and was proceeded ex-parte whereas the insurance firm filed a written statement admitting that the car was insured with it.

“The petitioners (family members of the deceased) are thus awarded Rs 17,68,673 with interest at the rate of 9 per cent per annum…,” According to the tribunal.
