Mumbai court warns prison Superintendent, guard for stripping inmate while searching

A special court in Mumbai has issued a warning to the Superintendent of Arthur Road Jail and a prison guard and directed them not to misbehave with an undertrial prisoner (UTP). The accused, Danish Ali, had alleged that the guard had misbehaved with him, abused him and made him strip naked in the presence of other prisoners.

Ali was booked in an extortion case linked with fugitive Don Dawood Ibrahim’s gang and has been pardoned by the court after he turned approver. Earlier, too, he had complained against prison authorities when he turned an approver in the case.

He had told the court that as an approver he was deposing against other accused in the case, but the prison authorities were transporting all the accused, including him, together in one vehicle between the jail and court. At that time, too, the superintendent was directed to arrange a separate police escort vehicle for him.

This time, Ali filed a complaint stating that guard Anil Ingale misbehaved with him and used abusive, filthy language. He alleged that he was singled out and his nude search was done when he was taken back to jail after attending the court hearing. Ali requested the CCTV footage of the prison entrance gate to be checked. He contended that the prison authorities could take his complete search but stripping him naked before other prisoners and staff only led to his humiliation.
